PLEASE READ THESE AURINFER LABS TERMS AND CONDITIONS ("TERMS AND CONDITIONS") CAREFULLY. BY ACCESSING OR USING THE AURINFER LABS WEBSITE (THE "SITE") OR BY ACCESSING OR USING ANY AURINFER LABS APPLICATIONS PROVIDED BY AURINFER LABS INCLUDING, WITHOUT LIMITATION, ANY AI-POWERED BOT CREATION AND MANAGEMENT TOOLS, (THE "APPS") OR BY ACCESSING OR USING OTHER AURINFER LABS MATERIALS PROVIDED IN ORDER TO FACILITATE USE OF THE SERVICES (THE "CONTENT"), (COLLECTIVELY, THE SITE, THE APPS AND THE CONTENT ARE THE "SERVICES"), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. YOU AGREE THAT THESE TERMS AND CONDITIONS ARE ENFORCEABLE LIKE ANY WRITTEN AGREEMENT NEGOTIATED AND SIGNED BY YOU. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS OR DO NOT WISH TO BE BOUND BY THEM, PLEASE EXIT THE SERVICES AND DO NOT USE THE SERVICES IN THE FUTURE. BY YOUR USE OF THE SERVICES, YOU SPECIFICALLY UNDERSTAND AND AGREE THAT THE SERVICES MAY INCLUDE THE USE OF ARTIFICIAL INTELLIGENCE ("AI") AND AURINFER LABS SHALL NOT BE LIABLE FOR ANY CONTENT, CHATS, BOT INTERACTIONS OR SIMILAR MATERIALS PRODUCED BY THE AI, EVEN IF SUCH MATERIALS ARE INACCURATE, DEFAMATORY OR OFFENSIVE. YOU AGREE THAT YOU ARE USING THE SERVICES AT YOUR RISK AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. AURINFER LABS MAY, AT ANY TIME, MODIFY, CHANGE, OR ADD TO THESE TERMS, AND ANY SUCH MODIFICATIONS WILL BE EFFECTIVE IMMEDIATELY UPON POSTING ON THE AURINFER LABS' WEB SITE. YOUR CONTINUED USE OF THE SERVICES FOLLOWING THE POSTING OF ANY CHANGES TO THESE TERMS AND CONDITIONS SIGNIFIES YOUR ACCEPTANCE OF THOSE CHANGES.

These Terms and Conditions, which include and hereby incorporate the Privacy Policy ("Privacy Policy"), are a legal agreement between AurInfer Labs, Inc. and its related companies ("AurInfer Labs", "us", "our", or "we") and you ("you" or "your"). By using or accessing the Service, you agree that you are 13 years of age and the minimum age of digital consent in your country, and if you are the age of majority in your jurisdiction or over, that you have read, understood, and accept to be bound by the Terms, and if you are between 13 (or the minimum age of digital consent, as applicable) and the age of majority in your jurisdiction, that your legal guardian has reviewed and agrees to these Terms.

Access to or use of the Services constitutes your agreement with these Terms and Conditions. You agree to use the Services only for lawful purposes. You may not use the Services for commercial purposes unless expressly permitted by a premium subscription. You must only use Services in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of Services. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of data within the Services, such as through spamming or excessive automation of bot interactions.

Subject to your compliance with these Terms and Conditions, AurInfer Labs grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use and access the Services for personal or community purposes, such as creating and managing AI-powered bots. You agree not to use the Services for any purpose other than as expressly permitted by these Terms and Conditions, or to copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, attempt to discover any source code, reverse engineer, decompile, disassemble, or otherwise exploit the Service or any portion of the Services or any AurInfer Labs Content, such as bot templates, code, or designs, except as expressly permitted.

You also agree not to resell, redistribute, or commercially exploit AurInfer Labs' assets, including bot templates, code, designs, or other platform resources, without explicit written permission from AurInfer Labs. You are solely responsible for any characters, personalities, or content you create on the platform; AurInfer Labs has no ownership, control, or liability for user-generated characters or their actions, including their interactions on external platforms like Discord.

No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by AurInfer Labs or its licensors, except for the permissions and rights expressly granted in these Terms and Conditions. AurInfer Labs reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice, and to refuse any user access to the Services without notice for any reason, including but not limited to a violation of the Terms and Conditions.

If you violate these Terms and Conditions, AurInfer Labs reserves the right to issue you a warning regarding the violation or immediately terminate or suspend any or all Accounts you have created using the Service, without prior notice, at its sole discretion. You are responsible for your log-in credentials and for any activity resulting from the use of your log-in credentials or other activity on your Account. Upon launching the App or the Service, if you do not already have an Account, you will be prompted to create one by providing a username and in some cases a password, and you may also be required to provide a valid email address or other information to access or utilize certain applications or features.

Any data, information, text, graphics, bot personalities, configurations, and their selection and arrangement, or any other materials uploaded to the Service by you, including without limitation, comments, settings, or bot interactions, is "Your Content." You represent and warrant that Your Content is original to you and that you exclusively own the rights to such content, including the right to grant all of the rights and licenses in these Terms and Conditions without AurInfer Labs incurring any third-party obligations or liability arising out of its exercise of such rights and licenses.

By uploading, distributing, transmitting, or otherwise using Your Content within the Service, AurInfer Labs shall be entitled to unrestricted use of such Content for any purpose whatsoever, commercial or otherwise, without the requirement of any further permission from or payment to you or to any other person or entity, including for inclusion in any future product, with no compensation to you. Your Content shall not be subject to any obligation of confidentiality on our part, and AurInfer Labs shall not be liable for any use or disclosure of Your Content.

All payments made to AurInfer Labs are nonrefundable, and Services and credits are consumable products that cannot be refunded or exchanged. Cancellation of your subscription will go into effect at the end of your current billing cycle, with no pro-rated refunds provided for early cancellations. In the event AurInfer Labs receives a fraud dispute or chargeback related to your payment, you will lose credits equal to the amount of the chargeback plus the fee levied by payment processors for handling the dispute (e.g., $15), and AurInfer Labs reserves the right to suspend accounts involved in fraudulent payment activities.

The Service allows for communication channels in dashboards, bot interactions, or connected platforms like Discord ("Communication Channels") to enable you to engage with other Service users. You acknowledge that any user content, including chats, bot interactions, or materials posted by users on the Communication Channels, is neither endorsed nor controlled by us, and AurInfer Labs will not be liable for any activity within Communication Channels, including interactions by AI bots created on the platform.

If you believe content on our platform infringes your copyright, submit a DMCA takedown request via our Trust & Safety form, including all required details, and we will review and address valid requests promptly.

These Terms and Conditions shall be governed in accordance with the laws of Dubai, United Arab Emirates, excluding its conflict of laws principles and the U.N. Convention on Contracts for the International Sale of Goods, and you expressly agree that exclusive jurisdiction for any claim or dispute with AurInfer Labs or relating to the Services or these Terms and Conditions resides in the courts of Dubai, United Arab Emirates.
